TERMS AND CONDITIONS

1. Introduction

These Terms and Conditions govern access to and use of:

• The Manzilini mobile application
• The Manzilini website
• The Property Management System
• All related services

By accessing or using the platform, you agree to be legally bound by these Terms.

2. Nature of the Platform

Manzilini provides a digital platform facilitating:

• Property rentals
• Property sales
• Property management services (where separately contracted)
• Coordination between tenants and landlords
• Agent operations

Unless under a signed Property Management Agreement, Manzilini does not own the listed properties and acts solely as a technology facilitator.

3. User Eligibility

Users must:

• Be at least 18 years old
• Provide accurate and complete information
• Have legal authority to enter into binding agreements

We reserve the right to suspend or terminate accounts that provide false information.

4. Account Responsibility

Users are responsible for:

• Maintaining confidentiality of login credentials
• All activities conducted under their account
• Ensuring information provided is accurate

5. Property Listings

Landlords and agents must:

• Provide truthful and accurate property information
• Verify ownership or lawful authority
• Avoid misleading descriptions or images

We reserve the right to remove listings that violate these Terms.

6. Payments and Commission

Where applicable:

• Commission structures are governed by separate Agent Agreements
• All payments must be processed through authorized Company channels

Circumvention of the platform may result in suspension and legal action.

7. Prohibited Conduct

Users shall not:

• Upload false or fraudulent information
• Bypass the platform
• Attempt unauthorized system access
• Engage in unlawful or harmful activity

8. Intellectual Property

All platform content, software, branding, systems, databases, and materials are the exclusive property of Manzilini Solutions.

Users acquire no ownership rights through use of the platform.

9. Limitation of Liability

To the extent permitted by law:

• We do not guarantee uninterrupted or error-free service
• We are not liable for disputes between landlords and tenants
• We are not responsible for property condition unless under a formal management agreement

10. Termination

We may suspend or terminate access to the platform for:

• Breach of these Terms
• Fraudulent activity
• Policy violations

11. Dispute Resolution

Any dispute arising from use of the platform shall:

• First be resolved amicably;
• If unresolved, be subject to the jurisdiction of the courts of the Republic of Kenya.

12. Amendments

We reserve the right to amend these Terms at any time. Updated versions become effective upon publication.

13. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Kenya.
